ESTA Compliance Deadline

March 21, 2025

An important compliance deadline is coming up related to the Earned Sick Time Act (ESTA).

As a reminder, the Earned Sick Time Act went into effect on February 21, 2025. This is a requirement for all businesses in Michigan to provide sick time to their employees.

  • Businesses with 1 – 10 employees have until October 1, 2025 to enact ESTA entitlements.
  • Business with 11+ employees must be complying as of February 21, 2025.
  • ALL businesses are required to notify their employees of ESTA entitlements by March 23, 2025.

Michigan’s Department of Labor & Economic Opportunity has posting requirements available on its website in English, Spanish, and Arabic. The Department also has promised a communication brochure to help businesses comply, but at the time of publication, that is still listed as ‘coming soon’.

The Department also has promised a communication brochure, but at the time of this publication, that is still listed as ‘coming soon.’ SBAM’s recommendation is to share the poster with your team ahead of the March 23rd deadline, if you have yet to communicate your ESTA compliance plans. Be sure to include how you will calculate the 12-month period information in the blank spot at the top.
