Court of Appeals lifts stay on vaccine and testing mandate

Last night, the 6th Circuit Court of Appeals lifted the stay on the federal OSHA vaccine and testing mandate on employers with 100 employees or more. This means that the mandate is back on, for now. The decision will be appealed by the US Supreme Court.

While SBAM opposes this mandate, we also want you to be prepared should the government prevail at the Supreme Court. SBAM has prepared an extensive FAQ that outlines who is covered and what the obligations of the employer would be under the OSHA rules. You can access that FAQ and other helpful information here. While certainly not guaranteed, we believe the Supreme Court will likely weigh in on this issue prior to January 4th when the vaccine and testing portion of the rule takes effect.
